Requirements for a Fiancé K-1 Visa

As the petitioner, you must be a U.S. citizen to bring your foreign fiancé to the United States. The K-1 visa allows your fiancé to lawfully live and work in the US.

Other requirements for the K-1 visa are:

• Both of you must be free to marry
• You must have met within the past two years
• You must have met in person
• You plan to get married within 90 days of your fiancé’s arrival in the U.S.
• You meet the income requirements
• Your fiancé is admissible to the United States
• Neither of you has a significant criminal history

If your fiancé has unmarried children under the age of 21, you may bring them to the United States with K-2 visas.

The K-1 Visa Application Process

The first step for the petitioner is to fill out and submit an I-129F form, Petition for Alien Fiancé to the USCIS field office closest to their place of residence. You must submit this form to a USCIS location in the United States. USCIS issues a receipt notification and number to the petitioner.

You should also provide relevant evidence of your relationship along with your petition, including:

• Photographs of you and your fiancé
• Copies of correspondence
• Proof of your finances

After the USCIS approves the petition, they send it to the National Visa Center (NVC) for processing. The NVC then applies a case number to the application and submits it to the U.S. consulate or embassy where your foreign fiancé will apply.

The U.S. embassy or consulate will give specific instructions to your fiancé, including where they must go for their mandatory medical examination. Afterward, your fiancé needs to visit the consulate or embassy for their scheduled immigration interview.

Your fiancé must bring the following documents to their visa interview:

• Online Nonimmigrant Visa Application DS-160
• Evidence of the medical examination
• A valid passport that is valid until at least six months after the intended duration of your fiancé’s stay in the U.S.
• Their birth certificate
• Any divorce or death certificate if either of you were previously married
• Proof of financial support to prove that they will not be an economic burden to the U.S. government
• The foreign fiancé(e)’s birth certificate
• A police certificate from the country in which they currently reside
• Two passport-style photos
• Evidence of your genuine relationship such as pictures and correspondence
• Payment for all visa fees
