Adoption and Guardianship

Many times a person may find that the child or parent’s best interest may be in adoption and/or guardianship. Most adoption situations arise where a step-parent wants to cement the child-parent bond by integrating all family members through the legal system. However, there are other cases in which a foster family may want to adopt a child in their physical custody or a grandparent or other care-taker may want to assume a permanent legal role in the child’s life.

Guardianships are different. In many cases, a biological parent may not want to terminate his or her rights, but temporarily give up their right as a parent for the best interest of the child. Additionally, we have seen guardianships awarded in cases were a child of an elderly parent may want to assist their parent with financial and health related issues. Additionally, a guardianship may be needed to take care of a disabled child or adult who may have future needs a parent cannot assist with. There are many cases in which a court ordered guardianship could be useful.
