Federal & Oklahoma Laws Covering Gender Discrimination
Three federal laws form the core of gender and sex discrimination protection for employees at private and public employers with 15 or more employees:
- Title VII of the Civil Rights Act prohibits employment discrimination on the basis of sex, including hiring, firing, pay, and any other term or condition of employment
- The Equal Pay Act prohibits paying women less than men for substantially equal work in the same workplace
- The Pregnancy Discrimination Act protects workers from adverse treatment related to pregnancy, childbirth, or related medical conditions
Title VII also covers gender stereotyping, which means treating an employee differently because they don’t conform to expectations about how a person of their gender should look or behave. In 2020, the U.S. Supreme Court held in Bostock v. Clayton County that Title VII’s prohibition on sex discrimination extends to discrimination based on sexual orientation and gender identity. That ruling applies to federal Title VII claims.
Oklahoma doesn’t have a state statute specifically prohibiting discrimination based on gender identity or sexual orientation. Oklahoma City has adopted nondiscrimination policies that provide some protections on those bases for city employees.
