Who Is Eligible for Family-Based Green Cards?

Working with a lawyer helps you determine which category of family-based green card you are eligible for and understand what forms you need to fill out and what supporting documents to submit.

Family-based categories for permanent residency in the U.S are:

  • An immediate relative of a U.S. citizen: spouse, unmarried child under the age of 21, or parent of a U.S. citizen
  • Another relative of a U.S. citizen or relative of a lawful permanent resident
  • The fiancé(e) of a U.S. citizen or the fiancé(e)’s unmarried minor child
  • The widow(er) of a U.S. citizen
  • A VAWA self-petitioner: abused spouse or unmarried child under 21 years old of a U.S. citizen or green card holder, or abused parent of a U.S. citizen



What Does Consular Process Involve?

Your U.S. citizen or lawful permanent resident relative must initiate the consular process by filling out and submitting Form I-130, Petition for Alien Relative. They generally need to send them to their local USCIS office.

If USCIS approves the petition, they notified your relative before transferring your application to the Department of State’s National Visa Center or NCV. Your file stays with the NCV until they assign an immigrant visa number to you. They may also request additional documentation from you to support your application. The NCV will schedule an appointment at the local embassy or consulate in the country where you currently reside. Showing up to this appointment is critical because if you fail to appear, it generally results in an automatic denial of your petition.

You need to notify the Visa Center after filing your petition if you:

  • Have turned 21 since submitting your application
  • Have a different marital status
  • Have moved

What Happens After the Consular Officer Approves Your Visa?

If the consular officer grants your visa request, they provide you with a “visa packet” that contains important information and allows you to legally enter the United States. Make sure not to open this packet and to keep it sealed.

When you arrive at your port of entry in the U.S., you must give your visa packet to the Customs and Border Protection officer. They review the packet and decide whether to admit you as a lawful permanent resident. If they admit you, you can legally and permanently live and work in the U.S.

If you paid the USCIS immigrant fee during your consular appointment, you may expect to receive your green card in the mail after you move to the U.S. If you have not received it within 45 days after entering U.S. territory, you should contact USCIS. If you have not paid the USCIS immigrant fee before coming to the U.S., you need to make the payment before USCIS can issue your green card.
