Who Is Eligible for a Family-Based Adjustment of Status?

You may apply for a green card via family-based adjustment of status while you are already and lawfully present in the U.S. The process does not require you to go back to your home country. If you currently live abroad, you may apply for a green card through Immigrant Visa Processing or IVP.

The following immediate relatives of a U.S. citizen are eligible for a family-based green card:

  • Spouse
  • Unmarried child under 21
  • Orphan adopted abroad
  • Orphan to be adopted in the U.S.
  • Parent if the U.S. citizen is at least 21 years old

The Family-Based Adjustment of Status Process

Petitioning for a family-based adjustment of status requires preparing a detailed and accurate application package for the U.S. Citizenship and Immigration Services, also known as USCIS. A green card application package through family-based adjustment of status usually includes:

  • I-485, Application to Adjust Status
  • I-693, Medical Exam Results
  • I-864, Affidavit of Support
  • I-765, Application for Employment Eligibility
  • I-131, Application for Advance Parole
  • I-130, Approval Notice

Once you have submitted all the required paperwork to USCIS, you can expect receipt notices within three weeks of filing each form. This notice includes the applicant’s Alien Number if they did not already have one.

A few weeks later, USCIS schedules a biometrics appointment at a local field office or application support center. During this appointment, USCIS representatives take the foreign national’s picture and fingerprints for the security background check.

You usually receive your Advance Parole documents 60 to 90 days after filing.

USCIS may schedule an interview, especially in the case of family-based adjustment of status through marriage. The agency generally sends you the interview date and location two to three weeks after your biometrics appointment. The notice states what documents you need to bring to the interview. The purpose of the interview is to confirm that the familial relationship is legitimate.

If you are applying for a green card through marriage, you usually need to provide these additional documents:

  • Proof that both spouses live together: joint lease or property deed, utility bills under both names
  • Joint finances: bank account or credit card statements, insurance policies
  • Photos featuring both spouses alone and/or with family and friends
  • Correspondence between both spouses while dating and married
  • Affidavits from U.S. citizens or permanent residents who can attest to the legitimacy of your marriage
  • Birth certificates of any child you have together

If USCIS approves your application, you become a lawful permanent resident. Depending on your situation, your green card may be valid for two or ten years. If you receive a two-year green card, you need to apply to remove the conditions on your permanent resident status at a later date. In either case, if you maintain your green card status, you can apply for naturalization in the future.
