Who Is Eligible to Apply for Naturalization?

USCIS requires that you meet a certain number of criteria to apply for U.S. citizenship. Assessing whether you meet all of them is the first step when you are considering naturalization. Although the law does not require you to work with an attorney for this process, hiring a trusted immigration lawyer can ensure that you not only meet the eligibility requirements but that you correctly prepare your application forms and supporting documents.

To apply for naturalization in the U.S. you must:

  • Be 18 years old or older
  • Be a lawful permanent resident for at least five years (or three years for spouses of U.S. citizens)
  • Have physically been in the U.S. for at least half of the required duration of permanent residency
  • Be of good moral character
  • Pass a test on U.S. history and civics
  • Read, write, and speak English
  • Take an oath of allegiance to the U.S.

In certain cases, minor children of naturalization applicants may be eligible and included in the application. If you are unsure whether your children are eligible, your immigration lawyer can review your situation.

What Does the U.S. Citizenship Application Process Involve?

If you meet the requirements to apply for naturalization, you need to put together your application package, which includes filling out and filing Form N-400 and providing enough relevant documents to support your application.

You usually need to include the following documents in your application package:

  • Birth certificate
  • Copy of your lawful permanent residency document
  • Marriage certificate (when applying when married to a U.S. citizen)
  • Residence and employment history for the required duration of permanent residency
  • Two passport size photographs
  • List of international travels during the required duration of permanent residency

At Mazaheri Law Firm, we carefully review your application to make sure all information is correct and that you included all necessary documents. Once we submit it to USCIS, they may schedule an appointment to collect biometric data from you.

The next step is an interview with USCIS personnel. Our immigration attorneys can assist you in preparing for this appointment. Just like for biometrics, USCIS informs you of the place, date, and time at which you must present yourself. The naturalization interview involves questions about your knowledge of U.S. government and history and your English literacy.

If you successfully pass the interview, you will receive a notice approving your application. You also get a list of questions that you must answer and turn in at the swearing-in ceremony. This ensures that all approved applicants have maintained their good character and status as lawful permanent residents between the interview and the ceremony.

After you provide your answers to those questions at the ceremony, a government official swears you in. You must surrender your I-551 card, also known as a green card, and you receive your naturalization certificate. U.S. citizenship does not expire, and you do not need to renew your documents.
